1. Eligibility & accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorised use.

2. The Service

CustomsAI provides AI-assisted tools including HSN/HS classification, duty computation, reverse code lookup, document checklists, risk and retrospective audits, notice-response drafting, and related workflows for Indian importers, exporters, and CHA desks. Features, limits, and pricing may change, and we may add, modify, or discontinue any part of the Service at any time.

3. No warranty on accuracy

Classification, duty rates, exemptions, and case-law references are generated using AI models and third-party data and may be outdated, incomplete, or wrong. The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. You must independently verify all outputs before relying on them.

4. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent, or infringing purpose;
• submit content you are not authorised to share, or that is confidential to a third party without permission;
• attempt to reverse-engineer, scrape, overload, or circumvent rate limits, credits, or access controls;
• resell or redistribute the Service or its outputs except as expressly permitted.

5. Plans, credits & payments

Paid plans and credits are billed as described at checkout. Credits are consumed per feature as shown in-app. Unless required by law, fees and credits are non-refundable once used. Taxes are your responsibility where applicable. We may change pricing prospectively with notice via the Service.

6. Your content & data

You retain ownership of the product descriptions, documents, and other content you submit (“User Content”). You grant CustomsAI a limited licence to process User Content to operate and improve the Service. Do not upload sensitive personal data you are not entitled to share. Our handling of personal data is described in our Privacy notice below and applicable Indian data-protection law.

7. Third-party services

The Service relies on third-party providers (for example, authentication, AI model, vector-search, and payment providers). Your use may also be subject to their terms, and we are not responsible for their acts, omissions, or availability.

8. Intellectual property

The Service, including its software, design, and content (excluding User Content), is owned by CustomsAI and protected by applicable laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

9. Limitation of liability

To the maximum extent permitted by law, CustomsAI shall not be liable for any indirect, incidental, special, or consequential damages, or for any duties, penalties, interest, fines, or losses arising from reliance on the Service or from any customs declaration you make. Our total aggregate liability for any claim shall not exceed the amount you paid to CustomsAI in the three (3) months preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold CustomsAI harmless from any claims, damages, or expenses arising out of your use of the Service, your User Content, or your breach of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination (including sections 3, 6, 8, 9, 10, and 12) will survive.

12. Governing law

These Terms are governed by the laws of India. The courts at our registered place of business shall have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
